Biography

Tim Rohs has served as an attorney in the Wilmington, Delaware office since its beginnings in 2007. His goal is to defend cases thoroughly and professionally, yet in the most cost-effective and practical manner possible.

A member of the bar for over 20 years, Tim’s practice focuses entirely on insurance defense, including representing individuals and corporations on behalf of their insurance carriers, as well as self-insureds. Tim also represents insurance companies in actions for coverage and first-party benefits. His practice also includes the defense of claims involving personal and commercial motor vehicle accidents, slip and falls, premises liability, product liability and construction defect claims.

Notable Cases include:

  • Matthews v. Food Lion, L.L.C., 2009 WL 756568 (Del. 2009) – Negligent supervision claim dismissed on summary judgment as court found no evidence employer was aware of employee’s dangerous propensities. Severe injury brain injury to plaintiff, who fell off the hood of co-worker’s automobile was not foreseeable by employer.  Affirmed by Delaware Supreme Court without decision.  Pretrial demand was $7,000,000.
  • Scheibe v. Fort James Corp., 276 F. Supp. 2d. 246 (D. Del. 2003). Case dismissed on summary judgment where plaintiff was unable to demonstrate defendant had a duty to protect him from dangerous machine alleged to have been previously owned by defendant.  Pretrial demand was $4,200,000.
  • Premcor Refining Group v. National Fire Insurance Co. of Hartford, 2012 U.S. Dist. LEXIS 49097 (D. Del. 2012). Declaratory Judgment action dismissed on summary judgment where defendant successfully argued plaintiff’s claim for indemnity was premature, and its claim for defense did not satisfy the requirements of the  additional insured provision in the policy.
  • Zonko v. Brosnahan, 2007 WL 3108201 (Del. Super.  2007). Homeowners who did not prevent minors from serving alcohol to other minors on homeowners’ property, were dismissed from case involving alcohol related fatal car accident, because Delaware does not recognize social host liability, and because alcohol is stringently regulated by the Delaware legislature, Court did not recognize plaintiff’s social host claim.  Pretrial Demand was $1,500,000.
  • Atwood v. Cameron, 2012 WL 3642707 (Del. Super. 2012). Claim against client dismissed pursuant to Statute of Limitations.  Plaintiff added client as defendant after expiration of the Statute of Limitations.  Court ruled client did not have notice of lawsuit prior to date required by Statute of Limitations.  Court rejected claim client’s alleged notice of incident and of initial lawsuit was sufficient to excuse the untimely filing.
  • Sykes v. NTB-Nat'l Tire & Battery, 2012 WL 1415794 (Del. Super. 2012).  Court granted client sanctions in excess of $5,000 after plaintiff failed to timely move to Amend Complaint to correct errors and defendant was forced to file Motion for Summary Judgment.  Given value of case, sanction was greater than plaintiff’s attorney’s likely fee, placing client in better position for settlement. 

During his final year of Law School, Tim received a Wolcott Fellowship, through which he worked as a Law Clerk for the Delaware Supreme Court.

Born and raised in Wilmington Delaware, Tim received a B.A. in psychology from Washington College in Chestertown, MD in 1989. He then received an M.S. in counseling psychology from Virginia Commonwealth University in 1991. After working as a counselor at a group home for the mentally ill, he attended Widener University School of Law, graduating in 1996. While in law school, Tim served on the Delaware Journal of Corporate Law. Tim also co-authored Law & Mental Health Professionals: Delaware (2000), along with Widener University Professor, Ann H. Britton.

When not practicing law, Tim is a member of the First State Symphonic Band, a community band based in New Castle County, Delaware, where has served as saxophone section leader, board member, and president.
