Defense Verdict – No Negligence

MSZLM Partner Stephen Ledva, Jr., received a defense verdict after a 3 ½ day Trial in the Court of Common Pleas of Allegheny County, PA.  The case was a combination of a products liability case failure to properly instruct in the use of two wheeled personal transportation device.  Plaintiffs were husband and wife in the mid 50’s who had traveled to Pittsburgh from Cleveland to enjoy the 4th of July weekend.  They took a tour of Downtown Pittsburgh when the Plaintiff’s wife fell and suffered severe fractures of her left hip.  Plaintiffs’ sought unspecified damages over and above approximately $60,00.00 in medical specials.  Mr. Ledva, in defense of his client, in particular, its instructor, had two-wheel individual transporter brought into the courtroom and had his client’s instructor both demonstrate in the courtroom how the transporter is utilized and essentials instruct the Jury in its use. The Jury came our finding no negligence against Mr. Ledva’s client.
