Marcel M. Flemming is an associate at Mintzer, Sarowitz, Zeris, Ledva, & Meyers. He concentrates his practice on defense litigation and corporate counseling. Mr. Flemming litigates a variety of cases including premises liability, medical malpractice, product liability, professional malpractice liability, casualty defense, commercial and contract disputes, and admiralty and maritime defense. His practice includes the defense of insurance carriers, physicians, hospitals, major cruise lines, airports, shopping malls, shopping plazas, and condominiums. He has also litigated in numerous jurisdictions in state and federal court as defense counsel on behalf of insurance carriers and their insureds.
Mr. Flemming has secured several defense verdicts, directed verdicts, summary judgments, and has successfully settled numerous cases for his clients as defense counsel. He has successfully defended corporations and major insurance carriers in multi-million dollar lawsuits.
His most recent highlights include obtaining summary judgment for a property manager in Key West; obtaining summary judgment for a Coral Gables-based general contractor; and successfully negotiating a settlement on behalf of a property owner who was found to have no liability and was excused from the matter without payment.
Mr. Flemming has successfully defended an internal medicine physician in a $2,000,000 medical malpractice action and obtained summary judgment for a well-respected orthopedic surgeon in Melbourne. He also successfully defended a Miami-based general surgeon in a $23,000,000 medical malpractice action saving both the insurance carrier and surgeon from liability of a multi-million dollar action. Mr. Flemming is creative, tactical, and works tirelessly to obtain the best result possible for his clients.
Mr. Flemming is a member of the Florida Bar Association, Dade County Bar Association, Broward County Bar Association, and the Young Lawyers Division. He is an honors graduate of the University of Detroit Mercy and Seattle University School of Law.
