James H. Fields, is an experienced and skilled commercial litigator and civil trial attorney with more than thirty years of experience. He offers perspective and counsel to help clients navigate potential civil damage issues to place clients in the strongest position to be successful in litigation, or, as the case may be, to help enable clients to achieve their objective to avoid litigation under the best possible terms.
Mr. Fields has significant experience in the areas of complex commercial litigation, employment litigation, and insurance defense. He has successfully litigated numerous matters involving contract disputes and business torts, including civil fraud, and claims arising out of, among other matters, business and asset sales, acquisition transactions, joint ventures, business break-ups, real property development and commercial leasing disputes. Mr. Fields also litigates affirmative and defensive actions in the area of employment litigation, including requests for emergency and injunction relief, involving employment agreements and noncompetitive agreements, and he defends wrongful termination and “for cause” claims.
Mr. Fields’ practice in the area of insurance defense encompasses a variety of areas, including premises liability, restaurant, retail and hospitality matters, special investigations, products liability matters, and defense of toxic tort/environmental claims. He has achieved significant success throughout his career in the defense of professional negligence claims and actions for catastrophic personal injury and wrongful death. Mr. Fields also has vast experience in the area of municipal liability. In this regard, among other services, Mr. Fields defends law enforcement officers against claims of alleged intentional torts, state and federal constitutional violations. To date, Mr. Fields has served as lead counsel or supervisor to designated lead counsel in over 200 civil law enforcement litigation matters, with a 91% win/loss ratio in matters that have gone to trial.
Mr. Fields practices in state and federal courts, at both the trial and appellate level. He provides skilled service in all trial practice forums, including arbitrations, administrative proceedings, hearings, bench trials and jury trials, and he has successfully represented clients and litigated cases in numerous jurisdictions throughout the country, including Maryland, Washington D.C., Virginia, Pennsylvania, Delaware, Michigan, Florida, Georgia, California, and Arizona.
Prior to joining Mintzer Sarowtiz, Mr. Fields operated his own law firm through which he provided targeted litigation and trial services to businesses, municipal agencies and private individuals in the areas of commercial litigation, employment litigation, insurance defense, and trial practice. Prior to operating his own firm, Mr. Fields, for nearly twenty (20) years, was a Principal and the Head of Litigation for a boutique business and litigation law firm in Baltimore, MD where he directed and supervised all trial practice and civil litigation services of the firm. Mr. Fields commenced his practice of law as a Litigation Associate in “big law”, principally in the areas of commercial, banking and business litigation, general insurance defense, products liability defense, and toxic torts.
A husband and father of four children, Mr. Fields resides with his wife and family in Baltimore, MD.
